FORMER DUMP SITE / PROPERTY CONDITION: Parcel 2, PID: 014-0030.002 was formerly used as a dump site. The dump site was properly closed and covered with guidance from the Wisconsin Department of Natural Resources (WI DNR). The Town of Fremont makes no representation or warranty, express or implied, as to the condition of the property, including the surface, subsurface, soils, groundwater, environmental conditions, or the presence or absence of buried materials, waste, contaminants, or other adverse conditions.
Buyer acknowledges and agrees that Buyer is relying solely upon Buyer’s own examination, inspection, investigation, and due diligence regarding the condition, zoning, use, value, development potential, and suitability of the property. Buyer assumes all risks and liabilities associated with the condition of the property and any future excavation, construction, development, use, or improvements following closing.
Buyer agrees, to the fullest extent permitted by law, to release and hold harmless the Town of Fremont, its board members, officers, employees, agents, and representatives from claims or liabilities arising from the condition, ownership, use, development, or improvement of the property following closing.
The property is being sold and accepted AS IS, WHERE IS, WITH ALL FAULTS, whether known or unknown. Buyer is encouraged to complete any inspections, environmental assessments, testing, or other due diligence deemed necessary prior to bidding. By bidding, Buyer acknowledges and accepts these terms.
