Terms and Conditions: Successful bidder will deposit 5% of purchase price as irrevocable earnest money down day of sale with balance due in certified funds upon closing, on or before May 10, 2017. Buyer receives full possession for the 2017 crop year. Possession will be available immediately after the auction, upon executing a purchase agreement. If the Buyer wishes to conduct any spraying, fertilizing, pre-herbicide, planting preparation, or any actual planting and if Buyer cannot complete the successful closing of the property then Buyer’s rights to the planted crops, all fertilizer, all herbicides, all completed spraying, shall belong to and be delivered to the Seller and retained by the Seller as liquidated damages, as well as the nonrefundable earnest money amount. The Buyer will be required to obtain and show proof of liability insurance naming the Sellers as additional insureds prior to possession. Property is selling in "as is" condition and without Buyer contingency of any kind, have financial arrangements secured prior to bidding. Marketable Title will be conveyed and owner’s title insurance will be provided with the cost of the owner’s policy shared equally between the Buyer & Seller. Clark Title Company will be the closing agent and their closing service fee will be split equally between Buyer and Seller. Seller is responsible for the 2016 real estate taxes payable in 2017. Buyer is responsible for 2017 taxes payable in 2018.
