Legal Description: A part of the Northwest Quarter (NW1/4) of Section 23, Township 90 North, Range 40 West of the 5th P.M., more fully described as follows: Commencing at the Southwest Corner of the Northwest Quarter (NW1/4) of said Section 23; thence South 87° 40’ East, along the South line of said Northwest Quarter (NW1/4) 103.30 feet to the Easterly right-of-way line of Iowa Highway No. 59, as filed February 16, 1972, in Land Deed Record Book 59, Page 376, Cherokee County, Iowa; said Point being the point of beginning; thence continuing South 87° 40’ East, along the South line of said Northwest Quarter (NW1/4) 1,218.00 feet; thence North 0° 13’ West, 553.85 feet; thence North 87° 40’ West, 1,183.00 feet to a point on the Easterly right-of-way line of Iowa Highway No. 59, as stated above; thence South 0° 13’ West, along the Easterly right-of-way line of said Highway No. 59, 82.40 feet; thence South 3° 50’ West, along the Easterly right-of-way line of said Highway No. 59, 471.10 feet to the point of beginning.
General Description: When was the last time you had this kind of opportunity! This site has a bullet propane tank (approx. 8,000 gallons) which supplies the entire property with propane. This site is also on rural water and REC elec. There is a well on the property which is also still in working order (no water tests available). The site is currently in DNR compliance. Buyer of the site will be responsible to implement their own manure management plan with DNR and transfer the well permit. This facility also has a onsite Winpower Generator for emergency backup power. All of the gating, bulk bins, controllers (phason in the farrowing/nursery/gilt rooms and airstream in the gestation/breeding barns), feeders and equipment pertaining to the direct operation of the facility will be included in the sale of the property. Any septic inspections and updates if needed will be the sole expense of the buyer. Method of sale: Property will be sold at 10:30 A.M. on September 7, 2021 at the site of the property. Property will be sold in total dollars.
Taxes: According to the Cherokee County Treasurer the current Real Estate Taxes are $1,114.00 per year. Seller will pro-rate the taxes to the date of closing.
Possession: Full Possession will be on closing day.
Terms: Purchaser(s) shall be required to pay a non-refundable 15% of the purchase price as earnest money deposit, and also agree to enter into a purchase agreement with the remaining balance due and payable on closing day on or before October 1, 2021, when the buyer shall receive a clear and merchantable title to the property.
